Distance Sales Agreement

This Distance Sales Agreement is concluded electronically between the Seller identified below and the Buyer who creates an accommodation booking through the website.

BUYER: the natural or legal person who provides their name, phone, e-mail and address in the booking form and warrants that this information is accurate.

The subject of this agreement is the provision of the accommodation service booked electronically by the Buyer via https://elustugroup.com, and the definition of the parties' rights and obligations.

Before completing the booking, the Buyer confirms having been informed of the essential characteristics of the service, the total price, the payment method, the cancellation and refund terms and all clauses of this agreement.

The unit type, check-in and check-out dates, number of nights and number of guests are shown in the booking summary and form an integral part of this agreement.

Nightly rates displayed on the site are indicative and may vary by dates, season and guest count. The binding amount is the total confirmed to and approved by the Buyer at booking confirmation.

All amounts are in Turkish Lira (TRY), including applicable taxes.

Payment may be made online by credit/debit card or by bank transfer.

Card payments are processed through the bank’s 3D Secure infrastructure. Card details are never displayed to, recorded or stored by the Seller; they are transmitted directly to the bank / payment institution.

For bank transfers, the booking becomes final once the amount is credited to the Seller’s account. If payment is not received within the stated period, the booking is cancelled automatically.

Pursuant to Article 15/1(g) of the Turkish Distance Contracts Regulation, contracts for ACCOMMODATION SERVICES TO BE PROVIDED ON A SPECIFIC DATE OR PERIOD are EXEMPT from the right of withdrawal.

Accordingly, the Buyer cannot exercise a 14-day withdrawal right after confirming the booking. The Buyer may, however, cancel or amend the booking under the Seller’s published cancellation and refund terms.

For Buyer-initiated cancellations: full refund if more than 14 days remain before check-in; 50% refund between 7 and 14 days; no refund within 7 days of check-in.

Refunds are issued through the original payment method. For card payments, crediting may take up to 14 business days depending on the bank.

For Seller-initiated cancellations, an equivalent alternative is offered; if declined, the full amount is refunded without deduction.

The Seller shall make the booked unit available on the agreed dates with the advertised characteristics.

The Buyer shall use the unit with due care, observe house rules and compensate any damage caused by themselves or their party.

If the declared number of guests is exceeded, the Seller reserves the right to charge extra or cancel the booking.

Neither party is liable where performance becomes impossible due to unforeseeable events beyond their control, such as natural disaster, fire, epidemic, official decisions or infrastructure failures.

In such cases the booking is postponed by mutual agreement or the amount paid is refunded in full.

Personal data collected for the booking is processed solely to provide the service and meet legal obligations, in line with Turkish Law No. 6698 on the Protection of Personal Data.

Consumer Arbitration Committees at the Buyer’s domicile or the place of transaction are competent up to the monetary thresholds announced annually by the Ministry of Trade; above these thresholds, Consumer Courts have jurisdiction.

By confirming the booking electronically, the Buyer is deemed to have read, understood and accepted all provisions of this agreement.
